IR35 reforms (off-payroll reforms) in the private sector have been delayed until April 2021 due to the Coronavirus pandemic. The reforms will mean that large businesses in the private sector will now be responsible for determining a contractor’s IR35 status and ensuring the correct taxes are paid. Liability for correct taxation will ultimately rest with end hirers, but HMRC will often look to collect first from employment agencies for any unpaid tax following successful status challenges.
